EPA Lead Paint Regulations

1. As part of a property damage cliaim are insurance carriers going to pay cost to test and possibly mitigate lead paint under the new regulations that go into effect April 22? 2. If they will pay what about claims that happened prior to 4/22 but will not have repairs done before deadline to test?

Kyle,
While the Lead RRP rule taking effect in April is new to some extent, the issue of lead paint in structures, the need to test and remediate are not. Similar to asbestos as a regulated substance, the EPA and OSHA have always mandated proper testing and removal. It's just now, more classifications of individuals must be certified, besides the remediation or restoration professionals.
