Judges rule family can sue employer for letting man drive while drunk

Can relatives of a “habitually intoxicated” Jackson County man who died in a traffic crash sue the man’s employer for letting him drive while drunk? On Tuesday, a three-judge panel of the Missouri Court of Appeals ruled that they can. In reversing a Jackson County judge, the appellate court found that the family of Scott L. Hays should get the chance to make its case to a jury. “A jury will be better equipped than we are to determine whether anyone, apart from Hays himself, can be said to be at fault for his death,” the court found.
