$400,000 settlement in livery cabbie’s death; struck by dump truck while tending to disabled car

The family of a livery cab driver from Bulls Head, fatally struck by a dump truck while tending to his disabled car in Meiers Corners, has settled its wrongful-death lawsuit for $400,000, their lawyer said. Chandana Asoka Sundarawadu, 51, was hit on Bradley Avenue in front of St. Rita’s School on the afternoon of Jan. 24, 2011, said court documents. Sundarawadu, who was driving for My Car Service in Tompkinsville, was heading toward the Staten Island Expressway when his car broke down, said his lawyer Edward J. Pavia Jr. of the Eltingville-based firm Jonathan D’Agostino & Associates. Sundarawadu pulled over to the curb on the narrow two-way street, Pavia said. Believing the car was out of gas, he fetched a gas can and went to the tank on the driver’s side of the car, Pavia said.
