The Louisiana Department of Insurance (LDI) has found evidence that McClenny, Moseley & Associates (MMA), a Houston-based law firm, engaged in an illegal insurance scheme involving Alabama-based Apex Roofing and Restoration.
As a result, Insurance Commissioner Jim Donelon has issued an emergency cease-and-desist order to MMA and its founding partners James McClenny and John "Zach" Moseley, as well as Louisiana managing partner William Huye, to stop their fraudulent insurance activity.
According to the LDI’s investigation, MMA misrepresented to multiple Louisiana insurance companies that they had been hired by policyholders to settle hurricane claims, when in fact they did not represent those policyholders.
The law firm made over 850 misrepresentations, knowing they were untrue, with the intent to deceive and defraud policyholders and insurers. MMA filed more than 1,500 hurricane claim lawsuits in Louisiana over three months in 2022.
Commissioner Donelon described the size and scope of the illegal insurance scheme as unprecedented, necessitating regulatory action to protect policyholders from further fraudulent activity. Policyholders who suspect that they may have been fraudulently represented by MMA are urged to contact the LDI Office of Insurance Fraud.
