An Ohio Supreme Court decision awarding uninsured motorists claims payments despite a signed letter rejecting the coverage from the policyholder is drawing fire from industry trade groups, which see the ruling as a catalyst for reopening old cases.

"It invalidates current rejection notices previously signed by insurers," said Rita Nowak, vice president of the property and casualty department at the Alliance of American Insurers in Downers Grove, Ill.

The decision increases an insurer’s financial exposures, according to Dave Snyder, assistant general counsel with American Insurance Association, based in Washington.

"The impact of this decision is the potential for insurers to pay for UM/UIM coverage on policies where such coverage was rejected,"
Mr. Snyder said.
