Making a clear distinction between different types of insurance coverages, the Ohio State Supreme Court overturned a ruling that awarded uninsured motorist coverage filed against a homeowners policy early last month.

"We are pleased the decision went in our favor," said John Bishop, president of Columbus, Ohio-based p-c insurer, Motorists Mutual Insurance Co.

"The court agreed with our defense, saying common sense alone dictates that the insurer nor the insured expected to be covered under this policy," Mr. Bishop said.

Two weeks ago, the high court denied an uninsured/underinsured motorist claim against a motor vehicle endorsement in a homeowners policy provided by Motorists Mutual.

In the case Davidson vs. Motorists Mutual Insurance Co., the insured, Gerald Davidson, sought to collect underinsured motorist damages following an auto accident back in 1995.
