A Michigan trial court has dismissed an action by a school district seeking coverage of year 2000 remediation expenses from a statewide insurance pool.

The ruling in School District of City of Royal Oak v. MASB-SEG Property and Casualty Pool Inc. follows the trend in other cases across the country in which courts have refused to uphold claims for Y2K computer upgrade expenses against insurers. (See National Underwriter, Jan. 8, 2001, page 1).

In the Royal Oak suit, the case was decided by Oakland County Circuit Court Judge Gene Schnelz.

The judge in his June 12 ruling noted that MASB-SEG had issued policies to the plaintiff and hundreds of other Michigan school districts over a number of years.
