Last month, the Iconoclast opened his examination of managed care by questioning who should be in control: patients, physicians, or accountants. This is the second in a three-part series on litigation management and prevention.

In far too many cases, a claim file that goes into litigation represents a failure. This is true whether that claim involves an auto accident, slip and fall, fire, or just a medical issue. Last month, we explored this point in connection with big business and insurance industry fears that the new patients’ rights legislation would allow lawsuits against HMOs and, perhaps, even the employers who provide the funding for managed medical care systems.

The solution to that dilemma, we suggested, was twofold. First, separate the maintenance contract aspect of managed care from the true insurance aspects.
