# Don’t Neglect Statute of Limitations

One seemingly obvious, but often overlooked, strategy for defending a claim is attention to the statute of limitations. Adjusters and attorneys who keep in mind this small detail may be able to save significantly in the disposition of a claim.

In a recent California case, mishandling on the part of the claim adjuster and the attorney ended up costing the client $125,000 in fees and expenses. Appropriate management, by either the adjuster or attorney, could have prevented this loss. The nature of the mishandling was the failure to pursue a winnable statute of limitations defense. Although, in this example, the client is a medical corporation who employed the doctors involved in the lawsuit, the principles discussed here cut across all areas of litigation and are not limited to malpractice.
