“Mold Is Gold!” This is the current motto of plaintiff lawyers throughout the country. Famous plaintiffs such as Erin Brokovich and Ed McMahon, as well as highly publicized multi-million dollar verdicts, only fuel the explosive growth of mold claims.

The question presented to the insurance industry is who is going to bear the costs of defending, assessing, investigating, and remediating mold claims. Although it is unlikely that mold will be the asbestos of the new millennium, it is clear that mold claims present a substantial exposure to the insurance industry.

In most jurisdictions, the operative event triggering coverage under a liability policy is the injury.
