Does homeowners insurance cover uninsured and underinsured motorists claims? That's the question before the Ohio Supreme Court, and insurers are anxiously awaiting a decision they fear could leave them facing exposures for which they say they never collected premiums.

About five years ago, a Jackson Township, Ohio, motorist involved in an auto accident received $100,000 in liability compensation from a standard auto policy covering the driver of the other vehicle.

However, he then sued his own homeowners carrier to collect on an underinsured motorist claim, citing a 1994 state law requiring insurers to include UM and UIM coverage in all auto liability policies issued in Ohio.

Both the trial and appeal courts agreed with his argument and now the case stands before the state’s highest court.
