In what is considered a significant premises and personal injury liability verdict for the ski industry, an Orange County, Calif., jury has returned a defense verdict in favor of a ski resort operator. The decision comes on the heels of another controversial skiing injury case in which a Vermont-based resort was found liable for injuries sustained by an off-duty employee.

In the California decision, Van Dyke v. S.K.I. et al, Ltd., 87 Cal. App. 4th 13680, the plaintiff was seeking damages in excess of $15 million as a result of being paralyzed in a skiing accident involving a collision with a signpost in 1994. In the complaint, the plaintiff alleged that the operator of the ski area had negligently placed the padded signpost at the intersection between two runs.
