On February 23, 2006, Louisiana Governor Blanco signed legislation (SB 7 Act 12) which prevents adjusters from denying homeowners’ claims based solely on floodwater marks or the displacement of property from its foundation. The bill also shifts the burden of proof from the homeowner to the insurer by invalidating portions of existing policies which relate to burden of proof.
