According to a report by the Associated Press, a man paralyzed in a crash with a Scotts Bluff County, Neb., sheriff’s cruiser that also killed his fiancee lost his fight to get money from the county’s insurance company. Scotts Bluff County District Judge Randall Lippstreu ruled in favor of Salazar and assessed damages at more than $7 million, however the judge also said the county only had to pay the $1 million cap set in state law regarding political tort claims. American Alternative Insurance Corporation which sold the county a $316,000 liability policy to cover claims exceeding the cap was said to be liable because it offered to pay $50,000 on top of the cap to settle the case prior to trial. Judge Lindsey Miller-Lerman ruled however that jsut the insurance company provided excess coverage for protection in a case with multiple, $1 million claims "cannot be viewed as creating any rights on the part of injured persons such as Salazar to recover more from the insurer than its insured was legally obligated to pay.’’
