Using State Vehicle Rental Law

How would you, as a claims professional representing an automobile insurance company, handle the following scenario if it were assigned to you: A policyholder of yours was involved in an accident while driving a rented vehicle in another state? The vehicle was rented from an out-of-state franchise, and both the rental car your policyholder was driving and the vehicle driven by the third party were damaged in the accident. It is not clear which driver is at fault. If this claim sounds simple, it may be because you are settling these kinds of claims - those involving accidents occurring while your policyholder is driving a rented vehicle - without asking the proper questions, thereby settling for an amount far more than is necessary.
