Premises Liability
Liability for injuries occurring on property owned or occupied by the insured due to dangerous conditions.
Premises liability claims include slip and falls, inadequate security, dog bites, and swimming pool accidents. CGL insures the business or property owner for negligence in maintaining the premises. Homeowners policies cover residential premises liability.
Examples
A visitor fractures a wrist on an icy untreated walkway; the property owner's GL or homeowners liability may respond.
Common Misconceptions
Assuming trespassers never recover — duties vary by status and state. Ignoring known hazards that create obvious negligence.
