Two shops have ended lawsuits filed against insurers that had been transferred to a U.S. District Court in Florida that has been overseeing dozens of similar lawsuits.
Professionals Autobody in Duncansville, PA, filed two lawsuits in 2017, one naming Kemper Insurance and one naming multiple insurers, including State Farm, Allstate and USAA, alleging bad faith, breach of contract, unjust enrichment and tortious interference for refusing to fully reimburse claimants for vehicle repairs.
The lawsuits sought about $8 million combined. The insurers made various arguments calling for dismissal of the lawsuits.
Kemper, for example, said Professionals already litigated its claims as a party in a similar lawsuit, brought by the Alliance of Automotive Service Providers of Pennsylvania and other shops, that was dismissed by the same U.S. District Court in Florida.
