This bill, if enacted, would mandate all firearm owners in Colorado to carry liability insurance. This insurance is designed to cover injuries or damages resulting from accidental or unintentional firearm discharges, not involving the policyholder. Key to this legislation is the protection it offers to victims of accidental shootings, allowing them to file claims against the firearm’s policyholder. Additionally, should the firearm be stolen and reported as such, the policyholder would be shielded from potential claims.

The Democratic party’s initiative, led by State Representative Iman Jodeh, frames this insurance requirement as a step towards reinforcing responsible gun ownership without infringing on constitutional rights. Jodeh highlights that such insurance policies, which could cost approximately $50 annually, are already available through existing homeowners and renters insurance packages. The bill is structured to ensure that financial constraints do not impede responsible gun owners from complying.

Conversely, Republican State Representative Ryan Armagost criticizes the bill, suggesting that it is part of a broader strategy to deter gun ownership. Armagost argues that the bill’s focus on unintentional shootings misses the mark, as these incidents are not typically associated with law-abiding citizens. He emphasizes the rarity of such occurrences among responsible gun owners.

As the bill proceeds to the Committee of the Whole, it continues to generate debate. Its proponents view it as a necessary step toward safer gun ownership, while detractors see it as an unnecessary imposition on the rights of gun owners. A first offense under the proposed law would result in a $500 minimum fine, with provisions to reduce the fine if compliance is achieved.
