California Homeowners Settles for $3.75 M
Tuesday, May 9th, 2000 PropertyA construction defect dispute that had been ongoing since 1997 settled recently on the courthouse steps. On the eve of the April 24, 2000 trial, Judge Ronald Bauer issued an order requiring all parties and their insurance representatives to mediate the case. The mediation resulted in the two principal parties to the dispute agreeing to settle for $3.75 million for the construction defects. The plaintiff in the case, the Summit Court Homeowners Association, represents a 243-unit condominium complex located in Anaheim. The complex was built between 1991 and 1995 by the now bankrupt master developer Baldwin Builders. Baldwin Building Contractors and L.P. Baldwin filed for Chapter 11 bankruptcy in 1995. The construction project encountered numerous delays and difficulties, including extreme winter weather exacerbated by El Nino.
