EPL Claim Trends Send Mixed Signals

The surrounding waters are a bit murky, however. This lack of clarity is caused both by contradictions among various data sources and uncertainty with regard to Equal Employment Opportunity Commission rulings, state and federal court decisions and the direction of general socioeconomic trends. It is well known that the number of EPL claims has increased several-fold since they first made their appearance about 20 years ago. Looking simply at the number of charges filed with the EEOC over the past eight years, however, it appears that, after a peak in 1994, the number is now fairly flat at close to 80,000 charges per year.
