Former Elmira, NY correction officer found guilty of insurance fraud

Friday, October 11th, 2013 Fraud Litigation Workers' Compensation

A West Elmira man and former state correction officer accused of defrauding a state insurance fund has been found guilty in Broome County. A jury on Wednesday morning found David R. Perry, 49, guilty of second-degree grand larceny, second-degree insurance fraud and first-degree offering a false instrument for filing, all felonies. The trial, which started last week, was Perry’s second trial on the matter. His first trial in August ended with a hung jury. Investigators said Perry, a correction officer at Elmira Correctional Facility, faked an injury to obtain a disability retirement. He was tried in Broome County because that’s where the office of the state insurance fund was located.
