General Contractor Wins $4.8 Million Verdict in Contract Dispute

CTA Construction Co., the general contractor for the renovation of the new Dedham Town Hall and Senior Center, has won a $4.8 million verdict in a lawsuit against the town of Dedham and its project managers. The Middlesex Superior Court jury awarded the verdict on October 3, 2023, with Judge Salim Tabit presiding.

The lawsuit stemmed from a dispute over the public construction project, where CTA Construction claimed the town was liable for breach of contract, breach of the implied covenant of good faith and fair dealing, and payment in quantum meruit for the value of work performed. Additionally, CTA alleged negligent misrepresentation, tortious interference with contractual relations, and violations of Massachusetts General Law c. 93A against Turowski2 Architecture and Atlantic Construction & Management.

The jury awarded $2,952,219.44 against the town of Dedham, $1,307,838.91 against Turowski2 Architecture, and $560,502.39 against Atlantic Construction & Management, totaling $4,820,560.74. The town had counterclaimed against CTA for breach of contract and indemnification for liquidated damages and costs, but the jury’s decision favored the plaintiff.
