Insurer loses another round
Monday, October 18th, 2010 Liability LitigationAn insurance company has lost another round in its seven-year legal battle to overturn what it believes was an unjust ruling by former Judge Michael Conahan that led to a $500,000 award in an uninsured motorist arbitration case. Luzerne County Judge Lewis Wetzel recently ruled that Harleysville Insurance Co. had failed to show that it was harmed by a drivers delay in reporting the presence of a "phantom" vehicle he alleged was partly responsible for an accident.
