Missouri Becomes 49th State to Prohibit Texting While Driving

Missouri Governor Mike Parson took a significant step in enhancing road safety last week by signing a bill that officially makes Missouri the 49th state to prohibit texting while driving.

SB 398 introduces new provisions pertaining to motor vehicles regulations for the use of electronic devices while driving and modify the permissible ways in which such devices can be utilized. The bill effectively bans various uses of electronic communication devices while operating a motor vehicle, while also providing exceptions. The law will be effective starting August 28, 2023.

In essence, the law prohibits texting and most other forms of cell phone use while driving; however, hands-free and voice-operated device usage appears to be allowed. Furthermore, the legislation introduces the possibility of misdemeanor or felony charges for vehicular accidents caused by distracted driving due to cell phone use.

The law includes specific exceptions allowing the use of electronic devices for emergency 9-1-1 calls, reporting crimes, communication between for-hire operators and dispatchers through permanently affixed devices, and for law enforcement and emergency medical personnel as part of their official duties.

Additionally, the legislation extends beyond texting while driving. It also prohibits activities such as watching videos, recording, sending, broadcasting, or participating in video conferences while operating a vehicle. The ban encompasses cell phones, digital assistants, computers, tablets, video game systems, and other electronic devices used for communication or internet access. However, non-commercial drivers are still permitted to use voice-activated functions on their devices.

With the implementation of this law, Missouri joins the majority of states in prioritizing road safety and combatting distracted driving. The measure aims to curb accidents and promote responsible and focused driving habits, ensuring safer roads for all residents and visitors in the state.
