Nursing Home Claims

Nursing home claims are increasing. The people have spoken and they intend to send a message, through high jury awards, that inadequate care will not be tolerated. While this means that the good facilities are paying the price for their negligent brethren through increased premiums, it also has resulted in an increased focus on risk management issues in nursing homes. Working with a legal nurse consultant (LNC) will provide the insight and clinical expertise to decipher allegations of negligence against nursing facilities. The LNC is familiar with the paperwork and care required for meeting various regulations. The most common claims for which my advice is sought involve three issues. The first of these, falls and injuries, may include falls from mechanical lifts, falls from the chair or bed, side-rail injuries, burns, element exposure due to elopement, skin tears, and fractures.
