Second Umpire Alleges Retaliation in Lawsuit Against MLB

Friday, October 11th, 2024 Insurance Industry Legislation & Regulation Litigation Workers' Compensation

A second minor league umpire has joined an ongoing lawsuit against Major League Baseball (MLB), accusing the league of wrongful termination following his report of a sexual assault. The lawsuit, initially filed in April by a minor league umpire, alleges that both plaintiffs were fired after reporting inappropriate conduct by a fellow umpire. According to the amended complaint, the second plaintiff was fired on April 1, allegedly for "performance issues." However, the plaintiff claims his termination was in retaliation for reporting a sexual assault incident involving a colleague after a charity event. The lawsuit also alleges the league created a hostile work environment and discriminated based on gender and sexual orientation.

MLB and the accused umpire have declined to comment. The legal proceedings now include claims of violations under Title VII of the Civil Rights Act of 1964, along with previous allegations of wrongful termination under New York state and city laws. Both plaintiffs have pursued their right to sue through the U.S. Equal Employment Opportunity Commission.
