The First 48 Hours

Monday, October 8th, 2001 Litigation Property Subrogation

When a claim ends up in appraisal or in litigation, the seeds may have been planted early in the claim. The first 48 hours following a loss are unique. They offer a one-time opportunity to minimize the loss and direct its outcome. Inertia during this critical period can lead to head-on collisions down the road. One thing is certain, those first 48 hours will not return. The effective adjuster will use those hours to uncover the unique hazards and opportunities in that loss, and out of a broad palette of alternatives, address the critical needs. Preserving the EvidenceRecovery through subrogation is extremely attractive to insurers, and the larger the loss the more attractive it becomes. But successful recovery depends on the carrier‘s ability to pinpoint a defective product or negligent action and to demonstrate its connection to the loss. Retaining the physical evidence is essential.
