Tough Calls On CGL Vs. Business Auto Claims

Closing our series on the CGL form’s toughest exclusions, we’ll look at exclusion "g" (the aircraft, watercraft, auto exclusion) and its attendant loading and unloading issues. There is sometimes confusion about whether the CGL policy or the business-auto policy covers injury or damage related to loading or unloading cars and trucks. The policies are drafted to dovetail. The BAP has its "exclusion 7. Handling of Property." This provision provides that there is no coverage for bodily injury or physical damage resulting from the handling of property 1) before it is moved from the place where it is accepted for movement into or onto the covered auto, or b) after it is moved from the covered auto to the place where it is finally delivered by the insured.
