Claim Disputes Easier To Argue Than Settle

We frequently receive questions from subscribers that, at first blush, appear easily answered. Then a new twist that turns a simple question into a coverage nightmare is added. For example, tree roots. We here at FC&S Bulletins have said that coverage for damage caused by tree roots is generally excluded. Some insurers have resolved this question by specifically excluding damage resulting from tree roots. But many insurers have not taken this path, so the contract language must serve in some way to exclude damage. The "wear and tear" list of exclusions is one such way—these are the exclusions for those things that will happen over time, and therefore are uninsurable.
