Massachusetts Psychiatrist Sentenced to Prison for $19 Million Insurance Fraud Scheme

Gustavo Kinrys, a 53-year-old licensed psychiatrist from Wellesley, Massachusetts, was sentenced to 99 months in prison for executing a $19 million insurance fraud scheme. Operating Advanced TMS Associates in Natick, Kinrys fraudulently billed Medicare and private insurers for thousands of transcranial magnetic stimulation (TMS) and psychotherapy sessions that never occurred between January 2015 and December 2018.

Kinrys claimed to have conducted over 8,000 TMS sessions and more than 900 psychotherapy sessions, including billing for 382 days where he allegedly provided more than 24 hours of services in a single day. He used the illicit proceeds to finance luxury homes in Wellesley and Nantucket and purchased over $600,000 in high-end jewelry from Cartier, Van Cleef, and Tiffany’s.

The Department of Health and Human Services Office of Inspector General uncovered the fraud, revealing that Kinrys created fake patient records to support his false claims. He also coerced an employee to fabricate records to deceive investigators. Kinrys was convicted on multiple counts, including wire fraud, false statements, and obstructing a criminal healthcare investigation.

U.S. Attorney Joshua S. Levy and other officials highlighted the impact of Kinrys’ actions, emphasizing how his greed undermined the healthcare system, increased costs for everyone, and eroded public trust. The FBI and other agencies involved in the investigation affirmed their commitment to prosecuting those who exploit the healthcare system for personal gain.
