Pa Supreme Ct Reinstates Asbestos Lawsuits
Tuesday, February 24th, 2004 Liability LitigationIn a 4-3 decision on Friday, Feb. 20, the state Supreme Court reinstated 376 asbestos lawsuits against Crown Holdings Inc. The decision declared unconstitutional a 2001 state law designed to protect the Philadelphia-based company. The majority said the Legislature impermissibly interfered with the judicial process by passing the law while lawsuits were pending. Crown Holdings, formerly Crown Cork & Seal, a packaging company that specializes in beverage containers, purchased and owned for three months before reselling Mundet Cork Corp., an insulation company that may have used asbestos material. The asbestos suits all pertain to Mundet‘s potential liability.
