Raising the Bar

In the past year, representatives of the property and casualty insurance industry and leaders of the defense bar have come together to discuss issues of mutual concern. These issues, which have caused a serious uproar in the relationship between the industry and the bar, find their roots in the industry’s drive to rein in claim transactional costs, including the cost of claim litigation, to retain a strong position in an increasingly competitive industry. Industry efforts to rein in litigation expenses fall into three areas: 1. fee audits; 2. claim handling guidelines; and, 3. in-house or staff counsel.
