Senate Approves Airline Liability Treaty

Monday, August 4th, 2003 Legislation & Regulation Liability

A standard worldwide system for compensating victims and their families for injuries and deaths resulting from crashes of international passenger jet flights could be just months away, following the U.S. Senate‘s approval of a treaty late last week. The Senate on July 31 approved a treaty that, under two key provisions, would impose strict liability on airlines for passengers‘ deaths and injuries and allow passengers and their families to sue in their local courts. The new liability system, known as the Montreal Convention, promises to eliminate the spate of varying government regulations and voluntary airline industry agreements on airline liability to international passengers.
