Court Rules Sky Betting Violated Data Laws to Target Problem Gambler

Sky Betting and Gaming, a unit of Flutter Entertainment, was found to have violated UK data protection laws by collecting and using the data of a gambling-addicted customer without sufficient consent, according to a recent High Court ruling. The company allegedly used cookies to profile the anonymous claimant for targeted marketing between 2017 and 2019. The case highlights concerns about how gambling companies utilize personal data and target vulnerable individuals.

The claimant, who reportedly lost more than £45,000 over ten years, argued that Sky Betting should have recognized him as a problem gambler and avoided sharing his data with third parties. While the court’s decision is specific to this case, it reflects broader scrutiny of the industry’s marketing practices. Regulators and advocacy groups have raised alarms about how such tactics contribute to gambling-related harm.

Sky Betting and Gaming, which has previously faced fines for breaching data protection and gambling regulations, disputes the court’s decision and is considering an appeal. The company asserts that it has implemented stricter safeguards, including financial vulnerability checks and deposit limits for returning customers. However, the judgment serves as a warning to gambling operators, who are under increasing pressure from UK regulators to prioritize safer gambling measures.
