Monday, May 13th, 1996 Auto Liability Litigation Property Risk ManagementJust because a legal precedent gives an insurance company the legal justification to deny a claim, it does not relieve that insurer from independently assessing the provision in question and addressing the claim in light of all relevant factors (including industry practice and professional commentary); the insurer cannot simply rely on a case ruling that favors the companys position. Were not talking legal right here; the insurer in this case is on firm legal foundation. It can deny the claim and withstand a bad faith challenge.
