Under this system, individual disputes are resolved by the courts, with the parties paying for the vast majority of this service. While generally strong, the system has become increasingly subject to abuse by a small segment of the legal profession. Examples of abuses include: 1. Class action lawsuits yielding little benefit to the plaintiffs while “their” attorneys realize massive fee awards. 2. Retention of attorneys by government officials without competitive bidding or public disclosure of the terms of the contract. 3. Forum shopping or picking the most favorable courts in which to file a case, rather than the court in a jurisdiction with clear relation to the alleged harm.
