Jeremy Shorr has initiated legal action against the Museum of Ice Cream after suffering significant injuries during a visit to its New York City location in March 2023. According to the lawsuit, Shorr, who was visiting the museum with his daughter, broke his ankle and sustained other injuries when he jumped into the facility’s sprinkle pool, an installation resembling a ball pit filled with large, plastic sprinkles. The complaint alleges that the museum’s marketing, which prominently encourages visitors to ‘jump in’ and ‘take the plunge’ into the pool, created a false sense of safety.

Shorr contends that the museum was negligent in multiple aspects, including the design, maintenance, and promotion of the sprinkle pool. The lawsuit claims that the museum failed to ensure the pool was deep enough or filled with sufficient material to cushion a jump, making it hazardous for such activities. Furthermore, the museum allegedly neglected to provide adequate warnings about the risks associated with jumping into the pool, despite being aware of previous incidents where visitors were injured. The lawsuit also references several social media posts and news stories highlighting the dangers, including instances where other visitors had suffered injuries after jumping into the pool.

The injuries Shorr sustained were severe, leading to a broken ankle that required surgery, ongoing physical therapy, and significant pain management. The lawsuit, filed in the New York Supreme Court, accuses the museum of prioritizing its marketing and financial interests over visitor safety and seeks damages for the permanent injuries and lifestyle impacts Shorr now faces.
