A $967,000 settlement has been reached between the city of Brentwood, California, and Talmika Bates, resolving a lawsuit over a 2020 incident involving a police K-9. Bates was bitten on the scalp by a police dog while hiding in bushes during her arrest for alleged shoplifting. The bite caused severe injuries requiring over 200 stitches, laceration repair, and ongoing treatment for traumatic brain injury and post-traumatic stress disorder.

Bates’ legal team argued that the officer’s prolonged use of the dog constituted excessive force under the Fourth Amendment. This stance gained traction after a federal judge limited the officer’s qualified immunity, noting the duration of the K-9’s attack as a potential violation of Bates’ rights.

Brentwood’s police chief emphasized that the officer’s initial deployment of the dog was deemed lawful but stated that the settlement was a practical decision to avoid costly litigation. Notably, Brentwood no longer operates any K-9 units within its police force. The case underscores the potential risks associated with using police dogs in apprehensions, raising questions about their role in law enforcement.
