The National Highway Traffic Safety Administration has directed autonomous vehicle developers to submit plans by the end of July to address what it called a clear pattern of driverless vehicles interfering with first responders. According to the agency, autonomous vehicles have entered active emergency scenes, blocked ambulances and fire apparatus, and failed to recognize emergency signals such as flashing lights, traffic cones, flares, smoke, and fire. NHTSA Administrator Jonathan Morrison said these situations are not rare exceptions and represent a significant safety deficiency that must be corrected.

While the directive does not identify specific companies, the incidents described closely align with reported events involving Waymo’s robotaxi fleet. Public reports have documented multiple occasions in which police officers or firefighters physically repositioned autonomous vehicles so emergency operations could continue. Additional incidents, including robotaxis becoming disabled during Fourth of July celebrations and one catching fire, have drawn attention to the challenges autonomous systems face in unpredictable environments.

For insurance claims professionals, the directive highlights a growing source of auto liability and property claims involving autonomous vehicles. Adjusters investigating collisions or losses near emergency scenes may need to evaluate whether an automated driving system properly detected emergency personnel and temporary traffic controls. Vehicle data, software logs, and sensor performance could become increasingly important evidence when determining liability.

The announcement also signals continued federal support for purpose-built autonomous vehicles. NHTSA said it is advancing updates to Federal Motor Vehicle Safety Standards that would remove several equipment requirements designed for human drivers, complementing earlier proposals to eliminate brake pedal requirements for autonomous vehicles. As robotaxi deployment expands, claims professionals should expect greater scrutiny of autonomous vehicle performance during emergency response situations and evolving regulatory standards that could influence coverage disputes, litigation, and subrogation efforts.
